It's even more interesting that the release number is not listed on the Apple site, which implies that the latest version will be shipped or made available via upload. In fact they are already talking about the Leopard release. I've been in software sales for 15 years, and I've never heard of selling a product, delivering an old version, and then demanding an upgrade fee.
